OneProfile
Terms of Service
These Terms of Service (the "Terms") are an agreement between you and OneProfile ("OneProfile", "we", "us"), a sole proprietorship based in the United States. They govern your use of the OneProfile desktop app, the OneProfile account you sign in with, and the services that support them (together, the "Service").
By ticking "I agree to the Terms of Service and Privacy Policy" when you create an account, or by using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't create an account or use the Service.
1. What OneProfile is
OneProfile is an app you install on your own computer. You enter a profile (a person's name, date of birth, Social Security number, address, income, driver's license and similar details) once, and the app uses it to fill in sign-up forms and prequalification checks on third-party websites (stores, card issuers, lenders and other businesses that are not us, "Third-Party Sites"), in a browser window inside the app.
- It runs on your computer. The app stores your profile, the passwords it creates or you save for Third-Party Sites, your Gmail connection and your results on your computer, encrypted with your operating system's key. They are not sent to our servers, unless you turn on backup, which sends your profiles encrypted on your computer with a passphrase only you know, so we can't read them. Our servers handle your account, your subscription, your devices and any backup, as the Privacy Policy explains.
- It acts on your instructions. Each run, whether of one site or many in a row, happens because you start it. When you run a site, the app sends that site the parts of your profile its form asks for, from your computer, as you would by typing them yourself. You are the one submitting each form, through the app. Likewise, if you turn on Inbox cleanup, the app unsubscribes you from the marketing email of the sites it signed you up for when you click Clean up now or, if you choose, after each scheduled run; each unsubscribe is your own request, sent from your computer to the email's sender.
- It is not a lender, broker or credit bureau. We don't make credit decisions, arrange credit, recommend products, or give financial, legal or tax advice. Any offer, approval, account or decline comes from the Third-Party Site, under its own terms.
2. Eligibility
To use the Service you must be at least 18 years old, live in the United States, and be able to enter into a binding contract. The Service is offered for use in the United States only.
3. Your account
- One person, one account. An account is for one person: you. Keep your password to yourself and secure. You are responsible for what happens under your account. Tell us at once, by messaging us on Telegram: @toniojx (https://t.me/toniojx), if you think someone else has used it.
- Accurate account details. Give a real email address that you control. We send codes and notices to it, and you need it to sign in on a new computer.
- No sharing or reselling. You may not share your account, let others use it, or sell, rent or sublicense access to the Service.
4. Plans, profiles and devices
| OneProfile Pro | OneProfile Run | |
|---|---|---|
| Price | $199 a month, or $699 a year | $50 per profile per run |
| Charged | Monthly or yearly, as you choose, in advance | When each run starts, before it runs |
| Computers | 2 | 1 |
| People's profiles | Any number | Any number |
Prices are in US dollars and do not include any sales tax, which we add where it applies. OneProfile Pro is the same plan billed either way: monthly or yearly changes only how often it is billed and what it costs.
OneProfile Business. OneProfile Business is by invitation only: we invite a business's account to it, at a monthly price we agree with that business, which can differ from one account to another. It allows any number of computers and people's profiles, and several of its computers may be in use at the same time. It is billed monthly, in advance, at its agreed price. An account invited to Business is offered Business alone, and has no free trial. Everything else in these Terms applies to it as to OneProfile Pro, and each profile is still one real person's, with their permission.
What a run is. On OneProfile Run, a run is one YOLO pass over all the app's sections (prequalifications, sign-ups, simple sign-ups and quotes) for one profile, or one site run by itself. Within 24 hours of a pass's start, every section's YOLO run and every site run again for the same profile are part of that pass; within 24 hours of a site run by itself, running that site again is part of it. Neither is charged again. Each other run is charged on your saved card when you start it, before it runs, and the app shows the month's runs.
People's profiles. Each profile is one real person's identity. Every plan, and the free trial, allows any number of profiles; on OneProfile Run, each profile's runs are charged as its own. Every profile but yours must be of someone who has given you their express permission to enter their information in the app and to submit it to Third-Party Sites on their behalf, and who meets the eligibility rules in section 2. You must be able to show that permission if asked. Never enter anyone else's information.
Computers. Your plan sets how many computers (each installation of the app) may be signed in to your account. A new computer is added when you sign in to your account on it with your password.
One session at a time. Your account can be in use on one computer at a time, except on OneProfile Business. To use it on another of your computers while the first is in use, you choose to use it there instead, and the first computer's session ends.
Swapping computers. You can remove a computer from your account to make room for another, up to 2 removals in any 30 days (on OneProfile Business, any number).
How we enforce this. Our servers check these limits, and the app shows what they allow. We may change the number of computers, people or removals a plan allows; if a change reduces what your plan includes, we will tell you at least 30 days ahead, and it takes effect at your next billing period after that.
5. The free trial
A new account can try OneProfile free for 30 sign-ups, once. The trial covers the app's sign-ups and simple sign-ups, for any number of profiles; prequalifications and quotes need a plan. Each sign-up uses one of the 30 when it starts, and our servers count them: running the same site again for the same profile doesn't use another. Each account gets one trial, and each computer can be used for one trial, whichever account it is signed in to. The trial starts when you first sign in, and ends once its 30 sign-ups are used (sign-ups already running then can finish). We don't ask for payment details for the trial, and it doesn't turn into a paid plan by itself: to keep using the Service afterwards, subscribe to a plan.
6. Billing, renewal and cancellation
- Payment. Payments go through our payment processor, Stripe. OneProfile Pro is billed in advance for the billing period that follows: a month on monthly billing, a year on yearly billing. On OneProfile Run, you save a card with Stripe when you choose the plan, and nothing is charged then; each run is charged on that card, $50 for its one profile, when you start it and before it runs. You give your payment details to Stripe, not to us (see the Privacy Policy).
- Automatic renewal and charges. Your Pro subscription renews automatically at the end of each billing period, each month or each year, and you authorize us, through Stripe, to charge your payment method then for the period that follows, at the price then in effect, until you cancel. On Run, you authorize us, through Stripe, to charge your saved card for each run you start, at the price then in effect, when you start it; nothing is charged when you don't start a run.
- Failed payments. If a Pro renewal payment fails, Stripe will try again, and you keep access to the Service for 3 days while you update your payment method. After those 3 days, access stops until the payment succeeds. On Run, a run whose charge doesn't go through (your card is declined, or your card's bank asks you to confirm the payment and you haven't) doesn't start: update your card, or confirm the payment on Stripe's page, and start it again.
- Cancelling. You can cancel Pro at any time from the app, which opens Stripe's customer portal for your subscription. Cancelling stops future charges. You keep access until the end of the billing period (the month, or the year) you have already paid for, and then the subscription ends. OneProfile Run has nothing to cancel: it charges only the runs you start, and you can remove your card in Stripe's customer portal at any time.
- Changing plans. You can move between OneProfile Pro and OneProfile Run from the app, which opens Stripe's checkout for the other plan. A move from Pro to Run saves your card for Run then, and takes effect when the Pro billing period you have already paid for ends: you keep Pro until then, nothing is prorated or refunded, and your first run after that period is charged as any run is. A move from Run to Pro takes effect once Pro's first billing period is paid for. A move to a plan that leaves more computers on your account than the plan allows needs a computer removed first.
- Monthly or yearly. You can move OneProfile Pro between monthly and yearly billing from the app, which opens Stripe's customer portal to confirm it. The move takes effect at once and starts a new billing period. From monthly to yearly, the yearly price is charged then, less a credit for the unused part of the month you paid for. From yearly to monthly, the unused part of the year you paid for becomes a credit on your account, which pays your monthly charges until it is used up. Such a credit has no cash value and isn't refunded.
- Promo codes. We may offer promo codes, each for a percent or an amount off, once or for a stated number of months, and some with a last day or a limit on how many times they can be used. On OneProfile Pro and OneProfile Business, you enter a code on Stripe's checkout page, and it comes off your subscription's charges as it says: "once" is your first month (on yearly billing, your first year), a number of months is each monthly charge for that long (on yearly billing, your first year's charge). On OneProfile Run, you enter a code in the app, and it comes off the runs you start after that: "once" is your next charged run, a number of months is each run you start for that long, counted from when you enter it. One code at a time on Run, each code once per account, and no run is charged less than $0.50. A run that is refunded, or whose charge doesn't go through, gives its code back for your next run. A code has no cash value, and we may end a code at any time; one you have already applied keeps applying as it said.
- Referral credits. Your account has a referral link and code to give to friends. When a new account enters your code before it chooses a plan, and then makes its first payment (a paid Pro or Business invoice, or a OneProfile Run run whose first site has started), your account gets a $50 credit. Credits come off your next charges automatically: each run on OneProfile Run before it is charged (no run is charged less than $0.50), or your next Pro or Business invoice. Credits never pay out as cash, can't be transferred or sold, and end if your account is closed. Each new account earns one credit, once, and none for an account of your own: we refuse a referral where the two accounts were used on the same computer or share a payment card, and we may take back a credit earned by abuse, such as fake accounts. A refund of the payment a credit was earned on doesn't take the credit back unless it was earned by abuse.
- Refunds. Payments are non-refundable, and we don't give refunds or credits for partial billing periods or unused time, except the credits of a move between monthly and yearly billing (above), and except that a charged run on OneProfile Run is refunded in full, automatically, if it fails to start, or if its first site never starts (the app closed first, say) and you don't start it again within the 24 hours its charge covers; and except where the law requires it.
- Price changes. We may change a plan's price. We will email you at least 30 days before a new price applies to you: on Pro, it applies from your first renewal after that notice; on Run, to the runs you start after that notice. If you don't want to pay the new price, cancel Pro before that renewal, or stop starting runs.
- OneProfile Business. Business is billed, renews, retries a failed payment and can be cancelled as OneProfile Pro is, at its agreed price. We may change that price: we will tell you before it applies, and it applies from your next billing period after that, never to a period you have paid for. We may end an account's Business access at the end of its billing period, or at once as section 12 allows; once it ends, you can choose another plan.
- Chargebacks. If you dispute a charge with your bank instead of contacting us, we may suspend your account while the dispute is open.
7. Third-Party Sites
- Their terms apply to you. Each Third-Party Site has its own terms of use, privacy policy and rules, which apply to you when the app uses that site for you. You are responsible for reading them and for complying with them, including any rules about how the site may be used. If a site doesn't allow something, don't use the app to do it there.
- Your answers to their forms. Where a Third-Party Site's form asks you to agree to its terms, or to be contacted by it, the app answers as your profile's settings say. That answer is yours, as if you had ticked the box yourself.
- You are the customer. An account the app creates on a Third-Party Site is your account with that business, and any prequalification, application or purchase is between you and it. We aren't a party to it and aren't responsible for what a Third-Party Site does with your information, how it treats you, or whether it is available.
- We don't control them. Third-Party Sites change their forms, add bot checks, and turn away automated or repeated visits. The app may stop working on a site at any time, and a site may limit, close or refuse an account that the app made for you.
8. No guarantee of results
- Sign-ups. We don't guarantee that any sign-up succeeds, that a Third-Party Site accepts the account, or that any offer, reward, discount or account feature will be available to you.
- Prequalifications are soft-pull only. The app submits a prequalification only where the Third-Party Site's own page says checking won't affect your credit score (a "soft" inquiry), and never where the page mentions a hard inquiry. It doesn't submit full credit applications. We rely on what each site says about its own check; we can't verify how a site or a credit bureau actually treats it, and we aren't responsible if a site's statement is wrong. If you go on to apply for credit yourself, the lender will usually make a hard inquiry.
- A prequalification is not an approval. We don't guarantee that you will prequalify, be approved, or be offered any rate, limit or terms.
- Inbox cleanup. We don't guarantee that a sender honors an unsubscribe or stops emailing you, and some senders are left for you to unsubscribe from yourself. The app can't undo an unsubscribe: to get a sender's email again, subscribe again on its site.
- Your profile. You are responsible for keeping your profile accurate, complete and current. The app submits what you entered. Entering false information on a credit or account form can be a crime.
9. Acceptable use
You agree not to:
- enter or submit anyone's information without their express permission, or impersonate anyone;
- give a Third-Party Site false or misleading information, or use the Service for fraud, identity theft, or to get credit, goods or benefits you aren't entitled to;
- use the Service in a way that breaks any law, including laws on credit, consumer protection, privacy and computer access, or any Third-Party Site's terms;
- get around the Service's limits, such as the number of computers, people or sessions, the trial, or the emailed codes, including by creating more than one account or resetting an installation;
- copy, modify, reverse engineer or redistribute the app, except as the law allows despite this limit, or remove or bypass any of its checks;
- interfere with, overload or try to get unauthorized access to the Service or our systems, or test their security without our written permission;
- use the Service to send unusual volumes of traffic to any Third-Party Site, or to disrupt one.
10. Your data and your computer
Your profile and results are stored on your computer. Unless you turn on backup, we have no copy of them, and if you lose your computer, its data or its operating system account, we can't recover your profile, saved passwords or results. With backup on, we keep a copy encrypted with your backup passphrase, which we never have: you can restore it on another computer with that passphrase, but if you forget it, the backup can't be restored, by you or by us. You are responsible for your computer's security, for keeping your passphrase, and for keeping backups.
11. The app and updates
While your account is in good standing, we give you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app on the computers your plan allows, for your own personal use under these Terms. The app, the Service and everything in them belong to us or our licensors; these Terms don't give you any other rights in them. The app checks for updates and installs them (or offers them for download) to keep working with our servers and with Third-Party Sites. Some updates may be required to keep using the Service.
12. Suspension and termination
- By you. You can stop using the Service and cancel at any time (section 6). To close your account and have its data deleted, delete it in the app (the Account card's Your data, Delete account), which cancels any subscription at once, with no refund for the rest of its billing period, or ask us on Telegram: @toniojx (https://t.me/toniojx) (see the Privacy Policy).
- By us. We may suspend or close your account, or require you to confirm a code before it is used again, if we reasonably believe you have broken these Terms, your account is being shared or used in an unusual way, it is at risk, a payment is past due beyond the grace period or disputed, or the law requires it. Where we can, we will tell you why and give you a chance to fix the problem first. If we close your account for a reason other than your breach of these Terms, we will refund any part of a billing period you have paid for and can no longer use.
- The Service changing. We may change or stop parts of the Service, including support for particular Third-Party Sites. If we stop offering the Service altogether, we will tell you at least 30 days ahead and refund any part of a billing period you have paid for after it stops.
- What lasts. Sections 7 to 10 and 12 to 17 continue to apply after your account ends.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL WORK WITH ANY PARTICULAR THIRD-PARTY SITE, OR THAT ANY SIGN-UP OR PREQUALIFICATION WILL SUCCEED OR PRODUCE ANY RESULT. Some states don't allow some of these disclaimers, so some may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, CREDIT DECISIONS OR THE ACTS OF ANY THIRD-PARTY SITE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM. These limits don't apply to liability that the law doesn't allow to be limited. Some states don't allow some of these limits, so some may not apply to you.
15. Indemnity
You agree to compensate us for, and defend us against, claims by others (including Third-Party Sites and anyone whose information you entered) and the resulting losses and reasonable costs, to the extent they arise from your breach of these Terms, your profile's information, or your use of a Third-Party Site.
16. Changes to these Terms
We may update these Terms and the Privacy Policy. Each version has a date-based version number, shown at the top. When we publish a new version, we will tell you by email or in the app before it takes effect, and the app will ask you to accept it before you go on using the Service. Until you accept it, you won't be able to use the Service, though you can still cancel your subscription. If you don't accept a new version, you can cancel, and you keep access under the version you accepted until the end of the billing period you have paid for. We will never apply a change to a dispute that arose before it.
17. General
- Governing law. These Terms are governed by the laws of the United States and the State of Nevada, without regard to its conflict-of-laws rules. Before filing a claim, each of us agrees to try to resolve the dispute informally for 30 days, starting when one of us writes to the other. Any claim that is not resolved must be brought in the state or federal courts located in Nevada, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court.
- Notices. We send notices to your account's email address, and they count as received when sent. You agree that we may give you these Terms, notices, receipts and other communications electronically. Send notices to us on Telegram: @toniojx (https://t.me/toniojx).
- The whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a part isn't a waiver of it. You may not transfer these Terms; we may transfer them to a business that takes over the Service, and we will tell you if we do. We aren't responsible for delays or failures caused by events beyond our reasonable control.
